Know Your Rights

If you are detained or arrested:

  • Anything that you say can be used against you. You have the right to remain silent. Speak to a lawyer before you provide any statement to police.
  • You are only required to provide your name & date of birth.
    DO NOT LIE.
  • You have the right to speak to a lawyer.  Ask police for a phone so you can speak to a lawyer

     

  • If you do not have a lawyer, Legal Aid
    Alberta has free lawyers.
  • You can ask for a translator if English
    is your second language.

  • When arrested, you will either be:
    a) Released ON SCENE or
    b) Taken to the POLICE STATION.

IF YOU ARE RELEASED
ON SCENE: Contact a lawyer, Legal Aid Alberta, or Calgary Legal Guidance (403 234 9266). You will have fingerprinting and court dates you need to attend. Missing those will lead to more charges. Write down for yourself later what happened with police to help you remember.

IF YOU ARE TAKEN TO THE
POLICE STATION: You have a right to a bail hearing within 24 hours of arrest. Duty counsel (a free lawyer) is available to help you. DO NOT RUN YOUR BAIL HEARING YOURSELF WITHOUT A LAWYER.
